Conditions of Use (Release 20.05.04)
These Conditions of Use only apply to orders which are processed in our online store.
Prices
The prices on our website are valid. All information is without engagement and non-binding. Mistakes, price changes and products changes are reserved. Books and maps have a controlled price. If there are unexpected price changes the customer is informed immediately. All prices are prices for end-customers. They contain the valid VAT (value added tax) which is regulated by law.

The sale contract is legally binding after the customer receives an acceptance of order or the ordered products.
Guarantee / implied warranty
The customer gets on all prducts the implied warranty of two years (starting with date of purchase). Products with a longer gurantee which is given by the manufacturer keep hold of this. Customers who call upon the warranty/ gurantee need the original invoice of the product.
For the assertion of the warranty claim it is necessary to send the goods back to us. The postal rates has to by paid by the customer. If the postal rate is not paid by the customer we cannot accept the delivery. Please inform us before you send back your ordered products.
We are not liable for damages which are caused by the use of products purchased at our store.
Selbstverständlich haften wir nicht für Schäden, die durch den Gebrauch der bei uns gekauften Artikel entstehen.
Replacement / Right to return / Right of withdrawal
You may return unused products within two weeks (for a full refund). You can withdraw from the contract within 14 days without giving reasons. The refund period starts with the day the customer receives the product. The right to return must be given in written form (Fax, Email) or by returning the product. If you want to return the product please inform us before sending the package. Otherwise we cannot accept the package free of charge. The product has to be returned as soon as possible in original packaging and with the orgininal invoice. These conditions apply only for end-customers. They do not apply for commercial customers.
Products which are manufactured especially for the customers cannot be return. There is no right of withdrawal for this products. Furthermore the right of withdrawal is excluded for books, magazines and security equipment such as ropes, cords, harnesses or carabiners.
Shipping to Germany
The order is delivered by DHL or DPD to the delivery address of the customer. The delivery period is 3-6 weekdays provided that the products are available from our stock or the stock of the manufacturer.
Shipping & Handling charges (Germany)
For packaging and postal rate of orders shipping to Germany we charge 4.90 EUR. Bulk goods and products over 31 kg are charged whith the costs thereby incurred. The customer is informed about these costs before the product is shipped. The customer has to pay an additional fee if the payment method is cash on delivery.
Shipping & Handling charges (Europe without Germany)
For packaging and postal rate of orders shipping to the following countries we charge 9.80 EUR: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Slovakia (Slovak Republic), Slovenia, Spain, Sweden. Bulk goods and products over 31 kg are charged whith the costs thereby incurred. The customer is informed about these costs before the product is shipped. The customer has to pay an additional fee if the payment method is cash on delivery.
Shipping & Handling charges (rest of the world)
For packaging and postal rate of orders shipping to countries not mentioned above we charge 30.00 EUR. Bulk goods and products over 31 kg are charged whith the costs thereby incurred. The customer is informed about these costs before the product is shipped. The customer has to pay an additional fee if the payment method is cash on delivery.
Payment
The following payment methods are available: Credit Card, cash on delivery, cash in advance. Another payment method can be discussed.
Damages in transit
The carriers are liable for defects according to their conditions of delivery. Please check if the products are free of damage and the order is complete when you receive the delivery. If there is a problem (damage) with the delivery please inform the carrier and us at once.
Reservation of proprietary rights
The sold product is the property of the Magic Mount - Alles für Berg und Tal GmbH until the customer pays the total amount for this product.
Severability clause
If some terms of this Conditions of Use are not legal the other terms of this Conditions of Use are not affected. The term which is not legal is replaced with legal regulation.
Jurisdiction
For commercial customers the jurisdiction is Dortmund, Germany.
Pricacy
Personal data of customers are only used according to the German Data Protection Act and the german Tele Services Data Protection Act. The user has the right to get information on which data is collected and for which objective. All data of customers is kept in confidence. Third persons only receive details of the customer to handle the order. Furthermore the user has the right to correct or delete the saved data.
Final clause
The legal requirements of Germany are valid for all contracts. The regulations of the UN Purchase Right do not apply for contracts between the seller and the buyer.
